By becoming a member of and using or accessing The Xeriscape Network and/or any of its services, you are agreeing to The Xeriscape Network’s terms and conditions. If you do not or have failed to comply with any of our terms and conditions, you are to cease your access of The Xeriscape Network.

Modification of the Terms and Conditions

We reserve the right to change and update these terms and conditions from time to time without notice. You acknowledge and agree that it is your responsibility to review these terms and conditions periodically to familiarize yourself with any modifications. Your continued access of The Xeriscape Network after such modifications will constitute acknowledgement and agreement of the modified terms and conditions.

1. Terms

By becoming a member of The Xeriscape Network, you are agreeing to be bound by these terms and conditions of service, all applicable laws, and regulations, and agree that you are responsible for compliance with any applicable local laws. If you do not agree with any of these terms, you are prohibited from using or accessing The Xeriscape Network.

2. Disclaimer

The materials provided by The Xeriscape Network are provided “as is”. The Xeriscape Network makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties, including without limitation, implied warranties or conditions of merchant-ability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights. Furthermore, The Xeriscape Network does not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the materials on its internet website, Discord server, or otherwise relating to such materials or on any sites linked to on this site.

The materials appearing on The Xeriscape Network’s services could include technical, typographical, or photographic errors. The Xeriscape Network does not warrant that any of the materials on its services are accurate, complete, or current. The Xeriscape Network may make changes to the materials contained on its services without notice. The Xeriscape Network does not, however, make any commitment to update the materials.

3. Links to External Sources

The Xeriscape Network has not reviewed all of the sites linked to on its internet website or within its community and is not responsible for the contents of any such linked site. The inclusion of any link does not imply endorsement by The Xeriscape Network of the site. Use of any such linked web site is at the user’s own risk.

4. Governing Law

Any claim relating to The Xeriscape Network shall be governed by the laws of The United States of America without regard to its conflict of law provisions.

5. Prohibited Actions & Content

When accessing The Xeriscape Network or its services, you will not:

  • Attempt to gather information from other users unless they are notified and have given explicit consent.
  • Post or distribute any pornographic/adult content including links to such content.
  • Upload or distribute any malicious content or viruses.
  • Engage in discriminant content or otherwise bully, harass, or intimidate any users.
  • Engage in illegal activities; Users will have to abide by the laws of The United States of America.
  • Attempt to circumvent any banishment without the consent of The Xeriscape Network.
  • Disrupt communications, see Disruption of Communication.
6. Disruption of Communication

Disruptive communication is anything that inhibits the clean, uninterrupted flow of communication between users of The Xeriscape Network. Disruptive communication includes but is not limited to:

  • Flooding: Posting an excessive number of messages is disruptive. Don’t do it.
  • Non-English Communication: The Xeriscape Network is an English speaking community. Communication, particularly content viewable by many users, will be conducted in the English language. THis also means that users will use the English language properly. “Leet speak” and alternating upper/lowercase letters (e.g. “tYpInG lIKe ThIS”) are difficult to read and will not be tolerated.
  • Off-Topic Posting: Posting content in which the information does not belong, as well as replying to content with unrelated information.
  • Miscellaneous: Any communication that disrupts the easy browsing of the site or community will not be tolerated. This includes exceedingly large pictures, large ASCII art, or links that go to a destination other than the one stated.

Discord Disclaimer

The Xeriscape Network’s Discord server can be accessed by anyone at any time, and all members who choose to use this service should be aware of such. Discord does have the ability to record, and The Xeriscape Network does not accept any liability for any information that you convey in any public Discord channel at any point in time, and the damages caused by releasing information across this service are the sole responsibility of the user who released the information. Always be wary of who you are speaking to, on Discord, or across any other service provided by The Xeriscape Network.

User Agreement

As a member of The Xeriscape Network community, you have access to the overall community and services provided by The Xeriscape Network, including participating in games like Destiny 2 through the clan system. Your use of these services signifies your acceptance of the disclaimers outlined in the user agreement.

  • Access to The Xeriscape Network is a privilege and can be revoked by the Administration team at any time without warning.
  • The Xeriscape Network reserves the right to modify or remove any services without notice.
  • By joining The Xeriscape Network, you agree to hold harmless the staff, owners, and all parties related to the community from any legal action or lawsuit.
  • By participating in The Xeriscape Network, you agree to do so at your own risk and acknowledge that we do not provide professional advice. We also do not guarantee the availability or functionality of the service, and any warranties, expressed or implied, are disclaimed.
  • You agree not to post any illegal or offensive material, including but not limited to: hate speech, threats, sexually explicit content, and illegal activities. Such actions may result in a permanent ban and may also be reported to law enforcement.
  • The Xeriscape Network shall not be responsible for any damages incurred as a result of participating within the community, including but not limited to, loss of profits, goodwill, data, or other intangible losses. This includes any damages that may occur from transactions made through the service, unauthorized access or alteration of data transmissions, or any statements or conduct of third parties using the service.
  • Any staff, owners, hosts, advertisers, officers, directors, employees, partners, and all other parties related to The Xeriscape Network’s community staff reserve the right, with appropriate permissions, to forcibly make you leave the community, permanently or temporarily, with no chance of rejoining – however, this will never be unwarranted. If there are no rule violations, you will not risk being punished or removed from the community, plain and simple.
  • By accessing The Xeriscape Network, you agree to keep yourself informed of any announcements or updates made by the community. Failure to do so will not excuse you from missing important information such as changes in community guidelines or updates.
  • By joining The Xeriscape Network, you are bound by the terms and conditions indefinitely, regardless of whether or not you continue to use our services or remain a member of the community.

By accepting The Xeriscape Network’s terms and conditions, you agree to abide by them indefinitely, even if you leave the community or discontinue use of a particular service.

Privacy Policy

The Xeriscape Network operates several services, including its Discord server and Minecraft server. In accordance with the running of these services, The Xeriscape Network does collect some non-personally identifiable information, such as timestamps and traffic data, as well as some personally identifiable information, such as Internet Protocol (IP) adresses.

It is The Xeriscape Network’s policy to keep this information safe, as well as to allow users to express concerns for how this information is being used.

Information We Collect

This notice applies to all information collected or submitted via The Xeriscape Network’s Google forms. Most notably but not limited to the membership application/recruitment form, which is used as an attestation of user age, and collects various demographic information such as first name, primary game, referral source, and gaming background. This function is analogous to a requirement to “register” for another website or webservice, such as a forum or message board.

The types of personally identifiable information collected on these pages or forms are:

  • Discord User ID (Snowflake)
  • Platform User IDs (e.g. Steam, Bungie.net)
  • User’s current age/date of birth
  • Geographic Location (Americas, Europe, Oceania, etc.)
  • Any other information provided voluntarily by the user as part of their background
How We Use That Information

The above information is only gathered when an applicant submits their membership application to formally request to participate in The Xeriscape Network. This information is never shared with outside organizations, and is used only for internal administrative purposes such as user role management, issue tracking, and metrics reporting.

The Xeriscape Network also makes use of third party services for text and voice communication, match/game session scheduling, and in game communication and clan functionality. The Xeriscape Network identifies these services and their privacy policies below under the section, Third Parties, but does not have governance over or responsibility for any personal information provided by the user to these services.

Protection and Distribution of Information to Third Parties

The Xeriscape Network discloses potentially personally-identifying and non personally-identifying information only to staff that need to know that information in order to process it on The Xeriscape Network’s behalf and have agreed to not disclose it to others. Some of these staff members may be located outside of your home country; by using The Xeriscape Network’s services, you consent to the transfer of such information to them.

The Xeriscape Network will never rent or sell potentially non personally-identifying or personally-identifying information to anyone. Other than to its staff team, as detailed above, The Xeriscape Network will only ever disclose potentially personally identifying information and non personally-identifying information to a court order or other government request, or when The Xeriscape Network believes in good faith that disclosure is reasonably necessary to protect the property or rights of itself, third parties, or the public at large. The Xeriscape Network will always take all measures necessary to comply with local, national, and international laws, where required.

The Xeriscape Network and its staff team take all measures reasonably necessary to protect against unauthorized access, use, alteration, and/or destruction of potentially personally-identifying and non personally identifying information.

If you post personal information publicly on the Discord server, in in-game chats, or anywhere else within The Xeriscape Network’s services, you understand that you are giving consent for that information to become public knowledge. The Xeriscape Network does not, nor will it ever require members to make any information public knowledge, and strongly recommends against it. As The Xeriscape Network has an international user base, you should always be wary of whom you are communicating with as well as how much information you have disclosed to them.

Third Party Platforms & Services

This section covers third parties which The Xeriscape Network’s users or members may come into contact with. The Xeriscape Network holds no responsibility or governance over data provided by the user to, or collected from the user by a third party.

Activision-Blizzard; Prior to Destiny 2’s migration from Blizzard’s Battle.net launcher to Valve’s Steam platform, members of The Xeriscape Network’s Destiny may have been required to provide certain information to Activision-Blizzard via Blizzard’s Battle.net software. The Xeriscape network does not supply members’ personal information to Activision-Blizzard, although Activision-Blizzard does collect and make use of user-provided information as part of their service.

Bungie; The Xeriscape Network maintains its clan pages on Bungie.net for the game Destiny 2. The Xeriscape Network does not provide Bungie with any personally identifiable information, although Bungie does collect and make use of user-provided information as part of their service.

The Xeriscape Network takes measures to protect the personal information that is collected through the Voluspa Discord bot. This includes implementing security measures to protect against unauthorized access, alteration, disclosure, or destruction of personal information.

User Rights

Please note that as the information collected is used for moderation purposes and to maintain the safety and enjoyment of the server, users do not have the right to request the deletion of their personal information. However, all logs are automatically deleted 30 days after their original creation.

Minecraft Service Level Agreement

Participation within the in-game environment provided by The Xeriscape Network’s Minecraft server, Telzenith, is provided under a basic service level agreement:

Server Network Guidelines

In accordance with our commitment to maintaining a respectful and enjoyable environment, we refer you to our comprehensive set of guidelines. These server network guidelines are detailed in the Minecraft section of the Community Guidelines on our website, and your participation on Telzenith is subject to adherence to these guidelines.

Event-Based Content

The live game environment of Telzenith is designed to evolve over time. The Xeriscape Network does not guarantee that players will be able to participate in all events or earn all in-game achievements or rewards. Some in-game elements, such as those associated with seasonal events, will only be available for a limited time.

When in-game elements are time-limited, Xeriscape will make reasonable efforts to communicate this information to players within Telzenith or through other means. Xeriscape reserves the right to extend the time limit for events at its discretion, with or without advanced notice.

Items earned during a specific event must be redeemed during that season unless Xeriscape chooses to provide a grace period for redemption, at its sole discretion.

Maintenance and Updates

Xeriscape does not guarantee the availability or continuity of the Minecraft server or its features. While we make every effort to maintain a stable and enjoyable environment, please be aware of the following:

  • The server may be patched and updated without notice. Any announcements regarding these updates, if provided, will be posted as announcements within the server or on our official communication channels.
  • In the event of server termination, which may arise from factors like limited player activity, technical restrictions, or shifts in our strategy, all access to the server network as well as any equipment, items, skills, and progress, will be lost.

You assume all risks associated with server termination and any potential loss of data. We strongly recommend staying informed about server updates and announcements by regularly checking our official communication channels to stay up-to-date on any changes to Telzenith.

Data Maintenance

When accessing Telzenith, please be aware that we conduct regular file cleanups to ensure the smooth operation of our server network. This means that if you are inactive for extended periods, some of your belongings and player data may be subject to deletion

LWCX (Lightweight Chests) Protection Locks
  • Annual LWCX cleanups occur on December 31st and a notice will be given on November 30th for players to prepare.
  • LWCX protections that have not been used for six months or more prior to the December cleanup will be removed from the database. To keep the protection active, use or interact with the locked inventory or object before the cleanup.
Player Data File
  • Your player data, including inventory, ender chest contents, experience, and log out location, are stored in a file called player.dat. This file is connected to your account and is used to track various states of your player on the server.
  • Inactivity on the Minecraft server for 90 days (3 months) will result in the deletion of your player data file, including your inventory, ender chest contents, player experience, and last log out location. The Xeriscape Network will not retain player data files for individuals who have not been active on the server for longer than 90 days (3 months), and this data will be reset upon your next login to the server.
McMMO Player Skills
  • Each player has a McMMO player skills file associated with them; This file contains information that includes player skill ranks and unlocked bonuses as well as any parties that player may be a part of or is the leader of.
  • If a player has not logged into the server for 90 days, their McMMO player file, which includes skill ranks, unlocked bonuses, and any parties they may be a part of, will be reset. This means that upon their next login, they will need to regain their skills and bonuses if they wish to have them again.
Player Jobs
  • Each player’s involvement in the player jobs system on the Minecraft server is tracked in a data file specific to that player. This file includes information such as the jobs the player has joined, their current level in those jobs, and their payrate for each job.
  • If you haven’t logged into the server for 90 days, your player jobs data will be deleted and reset when you next log in. This includes information about the jobs you’ve joined, your level and payrate for each job. You’ll need to rejoin any jobs you were active in if your data gets reset due to inactivity.
GriefPrevention Protection Claims
  • Land claim cleanups take place for individual users automatically after they have not accessed the server for a period longer than 60 days. After a 60 day inactivity period, protections claimed by that inactive player will expire.
  • Builds and modifications made to the environment within the previously existent claim(s) will not be reverted upon expiry to the original natural landscape. All builds and modifications will persist after the claim expires however they will no longer have a protection claim over them to prevent grief, theft, etc. by mobs or other players on the server.
  • Any player who comes across a region of the world previously protected by a claim may claim it as their own.
Cleanup Disclaimer

The Xeriscape Network will not provide support or compensation for anything you may have lost in one of these cleanups. It is the user’s responsibility to keep their stuff stored safely should they need to leave for an extended period for any reason.
